Over time, after the local business had made a name for itself through online sales, Nike sent a “voluntarily cancel” letter over his trademark. ⁠ ⁠ Fucik insists he had no intention of infringing on Nike's trademark stating: "I don't know how they found out about me. "I know they have a team of lawyers that this is what they do is peruse the internet, and look up, you know, small businesses."⁠ ⁠ Fucik has attempted to negotiate with Nike but has not heard back.
